CONDITIONS OF CARRIAGE

The Truck Transportation Act uniform conditions of transport shall apply.

PAYMENT GUARANTEE

The shipper agrees to pay the carrier all shipping charges in the event the receiver, on a collect shipment or the third party billing shipment, refuses to pay the carrier.

MODIFICATION OF CONTRACT

Any bill of lading constitutes the entire contract between the shipper, and no agent, servant, or representative of the carrier, has the authority to alter, modify or waive any provision of any contract.

LIMITATION OF LIABILITY

The amount of any loss or damage for which the carrier may be liable, shall not exceed $2.00 per pound (or $4.41 per kilogram) computed on the total weight of the shipment, to a maximum of $50 per shipment.

The parties agree that notwithstanding any disclosure of nature or value of goods, the amount of any loss or damage, including consequential, incidental or indirect damages, loss of earnings or profits, resulting from the loss of or damage to the goods and/or misdelivery, failure to deliver or delay in delivery of the goods, whatever cause including negligence of the carrier or those for whom it is in law responsible, shall not exceed the maximum liability of the carrier aforesaid.

POLLUTION LIABILITY

No carrier is liable for loss arising out of the actual, alleged or threatened discharge, dispersal, release or escape of pollutants which are at any time transported, handled or stored by the carrier for any person or organization.

GARANTIE DE PAIEMENT

L'expéditeur accepte de payer toutes les charges maritimes au camionneur en cas le récepteur, sur un chargement recueille ou la tierce personne facturant le chargement, refuse de payer au camionneur.

MODIFICATION DE CONTRAT

Ce connaissement constitue le contrat entier entre l'expéditeur et aucun agent, le domestique, ou le représentant du camionneur, a l'autorité pour changer, modifier ou déroger à n'importe quelle disposition de ce contrat.

RESTRICTION DE RESPONSABILITÉ

La quantité de n'importe quelle perte ou de dommage pour lequel le camionneur peut être responsable, n'excédera pas $2.00 par livre (ou $4.41 par kilogramme) calculé sur le poids total du chargement, à un maximum de $50 par chargement.

Les partis le conviennent malgré n'importe quelle divulgation de nature ou de valeur de marchandises, la quantité de n'importe quelle perte ou de dommage, en incluant des dommages importants, accessoires ou indirects, la perte de profits ou de profits, en provenant de la perte d'ou le dommage aux marchandises et-ou misdelivery, l'échec de livrer ou s'attarder dans la livraison des marchandises, quels que soit la cause en incluant la négligence en camionneur ou ceux-là pour qui il est dans la loi responsable, n'excéderont pas la responsabilité maximum du camionneur susmentionné.

RESPONSABILITÉ DE POLLUTION

Aucun camionneur n'est responsable pour la perte survenant du fait du renvoi réel, allégué ou menacé, la dispersion, la libération ou la fuite de polluants qui sont d'un moment à l'autre transportés, manipulés ou conservés par le camionneur pour n'importe quelle personne ou organisation.
